Marcellus Shale

As the Marcellus Shale industry continues to develop coupled with the next wave of natural gas exploration on the horizon in the Utica Shale play, it is important for landowners to know their rights with respect to the leasing of their oil and gas interests. It is just as important for the landowner to know the rights of the gas company in relation to the surface of their property once a lease has been signed.

At the Bernstein Law Firm, we have the knowledge and experience to represent you throughout the lease negotiation process. Our attorneys have represented landowners with less than one acre, farmers and agricultural properties with hundreds of acres, and industrial clients with active business operations on their property throughout the lease negotiation process. In addition to individual clients, we have also formed and represented landowner groups. The Bernstein law Firm has handled oil and gas lease matters at both the state and federal court levels and we represent clients in Pennsylvania, West Virginia and Ohio.

In addition to representing landowners in the oil and gas lease transaction, the Bernstein Law Firm is a well known leader in the area of Creditors’ Rights. In an industry that is fast-moving and operates twenty-four hours each day, it is important for the businesses that service the Marcellus Shale industry to know their rights and how to get paid. Our Creditors’ Rights attorneys represent clients in various types of creditor issues including foreclosure, mechanic’s lien claims, and construction and commercial collections. With extensive knowledge in this area of the law, we understand the competing interests that come into play between lessors and lessees, mortgagors and mortgagees and owners, general contractors, subcontractors and vendors during the gas lease development process.

Moreover, we can assist clients with mineral sales contracts and mineral deeds, various forms of land use agreements including pipeline agreements, easements and right-of-way agreements, gas storage agreements, zoning matters and timber harvesting proposals and contracts.

With all of the conflicting reports surrounding the Marcellus Shale industry, we focus first on educating our clients about the oil and gas lease terms and then work to complete the oil and gas lease transaction in a manner that maximizes the economic benefit for the client while protecting their property rights. Because of the competing interests that arise through the leasing of oil and gas rights, we feel that it is extremely important that each landowner is fully informed of the risks associated with signing a lease. In addition to counseling clients that have lease offers, we also represent clients that do not have an offer but have an interest in participating in the financial benefits associated with signing an oil and gas lease. Our Oil and Gas Law Group has an extensive network through which to secure offers for the lease or purchase of a client’s oil and gas rights.

We also have Business Law Group that works closely with our Oil and Gas Law Group that has substantial experience representing businesses of all sizes from start to finish. Our attorneys can assist in entity formation and organization, financing, acquisitions, commercial real estate transactions, and various contract matters. We also have experience in land use and zoning, construction law and other energy-related business including coal and landfill gas.

As a Business Law Firm specializing in Creditors’ Rights, we are positioned to represent not only the landowner but the businesses that support and service the Marcellus Shale industry. No matter who our client is, our core purpose is to create partnerships that provide clients with peace of mind through expert advice and zealous representation. If you are a landowner that is considering leasing your oil and gas rights, or if you are a business working in the natural gas industry, our team of experienced attorneys has the legal skills and knowledge to provide you with the information, advice and representation you need in a fast-moving industry that has been referred to the “Wild West”.
